Eligibility and Entitlement to Work in the UK

    As an employer, NHS Scotland must check a person’s eligibility to work in the United Kingdom (UK) for both new and existing employees. 

    This section of HR Connect is to provide guidance to managers and employee’s on the processes in place within your Board when an existing employee’s right to work in the UK is due to expire.

    As an employer, we are wholly committed to ensuring our EU staff and their families have access to up-to-date information, support and advice during this period of uncertainty. Over the coming weeks and months, we will be seeking clarity, establishing facts and ensuring that our EU staff are kept updated on developments as and when they happen.

    As the UK moves towards leaving the EU, The State Hospital is committed to supporting all staff affected by Brexit.  We will publish further updates and guidance on HR Connect as Brexit discussions progress.

    * EU countries are: Austria, Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and the UK.  The European Economic Area (EEA) includes EU countries plus Iceland, Liechtenstein and Norway. Switzerland is neither an EU nor EEA member but is part of the single market and therefore Swiss nationals have the same rights to live and work in the UK as other EEA nationals.
